When a Heart Attack is Due to Malpractice

A heart attack occurs when the flow of blood to the heart muscle is obstructed. Obstructions in the heart are generally caused when the walls of the arteries are thickened and narrowed by the growth of plaque along the walls of these vital blood vessels. Section 225 of the New York State Public Health Law specifies that all “places of public assembly” must have an AED. This includes sporting arenas, theaters, and concert halls. Additional provisions require AED devices in other locations such as swimming pools and schools.  If someone experiences a heart attack in a facility where an AED should have been available but was not, that facility may bear liability for the resulting harm.
