How can I prepare for a medical malpractice trial?

If your medical malpractice trial has reached the stage in litigation where your case actually goes to trial there are a few things that you should know in order to prepare yourself. The preparation will begin roughly 2-4 weeks before the trial, giving your lawyer ample time to prepare their arguments and present your case in front of a judge and jury.

 

You want to be actively involved in your case with your attorney. You can expect to speak with your attorney on a daily basis if you have not been doing so all along. You want to prepare yourself for the possibility that you may have to take the stand in support of your case. Talking in front of a group of strangers can be a nerve wracking experience so it is best to prepare yourself by practicing what you will say and preparing for any hard questions the other attorney may ask you.

 

Sometimes some of the more important aspects of the trial are the unspoken ones. How you dress, carry yourself and your body language can make all the difference. You don’t want to wear anything that would distract the jury at all. Neutral colors are the best option; and jewelry should be kept to a minimum.

 

Depending on the complexity of your case, the trial could take anywhere from one to six weeks or more presenting evidence and calling expert medical witnesses to establish the appropriate standard of care you should have received, what the doctor did wrong, and how you suffered as a result of the treatment.

 

The best way to approach your trial is with preparation. Making sure that you pay full attention to your attorney’s requests can make the difference between winning and losing your case. Our advice is to get you ready for trial and win your case.
