Medical Malpractice Timeline

The medical malpractice timeline in most cases is 2.5 years from the date of malpractice or from the end of a continuous treatment that caused you harm.  Before even worrying about the timeframe you need to find a lawyer. Medical malpractice cases are not something a person should take on alone.

Lawyers will do the legwork and find out the critical information for your case. This may take a few months to accomplish as they will need to have all the evidence to win. After the lawyer has gone through your paperwork they will then make a decision if this is a case that can be won and if so they will proceed. The lawyer will also find an expert medical witness to attest to the fact that something was done wrong and support the case.

Then after all that is done the lawsuit will be filed. This is why it is imperative to seek the help of a lawyer immediately after something happens. For example, if your state has a statute of limitations of  6 months and you wait 3 months before finding a lawyer you are only giving that lawyer 3 months to do what typically takes him 4 or 5 months.

Another thing to keep in mind is that if you file quickly after the incident, procedure or event, then you can collect evidence, such as pictures. Your memory will be much better when it is closer to the malpractice. This way, you can compile your statement and your side of the story.
