Nursing Home Abuse & Personal Injury Law

Although nothing is inexpensive in New York, the costs associated with long-term care (nursing homes) are particularly staggering. On average, a person will spend about 2.5 years living in one, which could cost upwards of a hundred thousand dollars a year. Before you begin to concern yourself with how much they cost, take some comfort in knowing there are several legal methods available to afford them.

However, Silberstein & Miklos P.C. is not the type of firm that handles that area of the law. If we focus on personal injury and medical malpractice claims, why are we bringing them up? Despite the money that people spend on nursing homes, it is estimated that more than 300,000 New Yorkers are victims of nursing home abuse each year.

The Importance of Skilled Attorneys

To be frank, nursing home and elder abuse are abhorrent. Additionally, we are not making blanket statements about nursing homes. When it happens, we are proud to stand up for those who can’t. Our government has concluded that they lack the state and federal resources to protect patients from abusive individuals in nursing homes. The federal government has provided laws and regulations for the standard of care they must provide. Here are some of the things nursing homes must provide:

  • Physician supervision for each resident
  • Maintaining accurate clinical
  • Assessments of their mental and physical well-being
  • Providing health care and activities
  • Maintaining a sufficient nursing staff
  • Allowing tenants to manage their own finances
  • Tenants can participate in their own medical care

Again, these are only a few of the rights and responsibilities of the tenants and staff. Whereas the government may not have the resources to protect patients, they have provided us with state and federal laws that enable people like us to take appropriate legal action when necessary.

When Should You Contact an Attorney?

Uncovering nursing home abuse is challenging because your loved ones may be frightened or unable to tell you about it. For this reason, you should be aware of certain signs or behaviors that indicate that you may need the assistance of legal counsel. Does the nursing staff refuse you visitation time? When you visit, does it look like the room is being cleaned regularly? You should also be concerned if your loved one is dehydrated, becomes withdrawn, or has inexplicable bruising. People who are being mistreated may demonstrate a behavior change. For instance, they may exhibit signs of depression or become easily agitated over minor issues.
