Types of Hospital Errors in the Bronx
According to a 2016 study by John Hopkins University, 10 percent of all deaths in the United States can be traced to errors within the medical field. Hospital errors can happen in nearly any department, no matter the age or condition of the patient. Common types of hospital errors include:
- Adverse drug events
- Urinary tract infections from catheter placements
- Adverse events involving pregnancy and birth
- Infections in surgical sites
- Blood clots
- Pneumonia related to ventilator use
- Bed sores
Causes of Medical Facility Errors
When hospital staff follows medical protocols and standards, the risk of preventable errors is normally small. However, the risks can increase in various situations. Common causes of hospital errors include:
- When protocols are not followed as they should be
- When doctors lack adequate training or knowledge
- When staff do not have adequate sleep because of staff scheduling
- When staff miscommunicate
- When a hospital does not maintain proper patient records
When these mistakes happen and cause errors in treatment, hospital staff can be held accountable for the injuries and damages they cause to patients. Our Bronx hospital error attorneys are experienced in establishing negligence in these types of cases.
Certificate of Merit by Expert Medical Witnesses
To reduce the number of lawsuits that do not have any basis, New York Civil Practice & Law Rules § 3012-a requires that a certificate of merit be filed with all medical-related lawsuits.
The certificate of merit must certify that the attorney has reviewed the case with a medical expert and that the expert believes the hospital error claim is valid. Alternatively, the certificate may state that the lawyer made three individual good faith attempts to obtain the opinion of a medical expert and was not able to do so.
The only exception to this law is if obtaining the certificate would delay the filing of the lawsuit past the statute of limitations. In this situation, there is a 90-day extension for filing the certificate of merit. If a hospital error case is filed without a certificate of merit or without requesting this extension, the judge may choose not to hear the case.
