Certificate of Merit by Expert Medical Witnesses

To reduce the number of lawsuits that do not have any basis, New York Civil Practice & Law Rules § 3012-a requires that a certificate of merit be filed with all medical-related lawsuits.

The certificate of merit must certify that the attorney has reviewed the case with a medical expert and that the expert believes the hospital error claim is valid. Alternatively, the certificate may state that the lawyer made three individual good faith attempts to obtain the opinion of a medical expert and was not able to do so.

The only exception to this law is if obtaining the certificate would delay the filing of the lawsuit past the statute of limitations. In this situation, there is a 90-day extension for filing the certificate of merit. If a hospital error case is filed without a certificate of merit or without requesting this extension, the judge may choose not to hear the case.
