New York Cardiac Malpractice Attorneys

Cardiac malpractice involves misdiagnosing or mistreating a patient who suffers from a heart problem. Because heart attacks are one of the leading causes of death in the United States, cardiac malpractice is always a serious matter. In fact, thousands of patients suffer and die every year due to heart problems that could have been avoided. When this occurs, it is imperative to consult with a medical malpractice lawyer to hold the negligent parties responsible and recover compensation for any damages.

At Silberstein, Awad & Miklos, our New York cardiac malpractice lawyers have experience representing patients who have been victims of cardiac malpractice. If you would like more information about some of our past cases, we have additional details available.

Elements of Cardiac Malpractice

Cardiac mistakes can take many forms. Our New York cardiac malpractice attorneys have handled cases where a patient’s complaints of chest pain or tightness are ignored or minimized by a treating doctor or hospital. These complaints often progress until a heart attack occurs. Very often complaints by a patient who is a woman are minimized or blamed on a variety of so-called women’s problems or emotional problems. In reality she is having the signs of an impending heart attack. Family histories of cardiac disease are not given enough importance. Sometimes the cases involved a failure to refer to the appropriate cardiac specialist.

The next type of cardiac malpractice that we see is related to EKGs or electrocardiograms. These cases center upon a failure to properly investigate the patient’s complaints with an EKG or the misinterpretation of the EKG results. Subtle but distinctive patterns of abnormality are reflected on an EKG and are misinterpreted by a physician or physician’s assistant. This usually results in disabling cardiac conditions or even death.

Lastly, cases of malpractice relating to the heart involve issues of treatment. When the heart is suffering what is called a heart attack or a myocardial infarction, time is equal to muscle. What this means is that once a heart attack has been diagnosed, the faster treatment is started, the better a patient’s chances are. Put another way, that means that the quicker treatment is instituted, the less damage is likely to occur to the heart. There are all sorts of interventions that cardiologists use to reduce the chances that damage to the heart muscle will occur. These include medication, stents, and bypasses. In rare cases, cardiac transplants are performed. Our New York cardiac malpractice lawyers have successfully handled cases for our clients in which there was a delay in treatment or there was an error in how a medical procedure was performed.
